 16. Chapter VI - Final and Transitory Regulations
 

Article 100

Incorporation of Dental Surgeons

1 - All Brazilian dental surgeons in compliance with Decree no. 180-A/92 dated 4 June 1992 and with the agreement memorandum dated 9 February 1994, shall be entitled to the degree of dental practitioner and, as a consequence, to registration in the OMD, including all the rights and duties inherent to it, provided that they meet the following requirements:

a) have graduated from Dental School by 1993;

b) can prove their entry into Portuguese territory before 31 December 1993;

c) are registered or legally qualified to register in the Federal Dentistry Council (Conselho Federal de Odontologia - CFO).

2 - Success in obtaining the dentist degree as well as registration in the OMD shall depend, in every case, on the attendance of a training course provided by the OMD regarding ethics, professional conduct and legal aspects in force in Portugal.

Article 101

Automatic Registration in OMD

1 - Those dental surgeons complying with the requirements defined in no. 1 of the previous Article, whose training covered a minimum of 4,500 hours shall be granted the degree of dental practitioner and registration in the OMD, after completing the training course mentioned in no. 2 of the said Article.

2 - The minimum hours mentioned in the previous paragraph shall be the number of hours for each subject in the dental school programme, as specified in the transcript. Should the transcript show the number of credits for each subject, these shall be translated into the corresponding number of hours.

3 - Those dental surgeon who do not have the minimum number of hours required for automatic equivalence, may add the hours of complementary training, such as:

a) continuous and professional training courses, provided that the certificates mention their duration in hours;

b) post-graduate courses, namely internship, specialty, master and PhD programmes, provided that the certificates mention their duration in hours;

c) other studies such as supervised internship and scientific research works, provided that the certificates mention their duration in hours;

d) teaching activities, provided that the certificates mention their duration in hours.

Article 102

Continuous Training

1 - Those dental surgeons who, in spite of that established in the previous Article, still do not comply with the minimum hours required for automatic equivalence, shall attend a continuous training programme (CTP) given by the Portuguese and the Brazilian Dental Associations.

2 - The CTP shall be structured in quarterly modules, without any module evaluation or examinations, and shall be in operation until July 2000, in accordance with the terms to be defined by the Portuguese and the Brazilian Dental Associations.

3 - Dental surgeons shall be entitled to the dentist degree and to registration in the OMD immediately after completing the CTP.

Article 103

Department of Dental Surgeons

1 - A Department of Dental Surgeons is hereby created within the ambit of the OMD, in accordance with specific regulations to be approved.

2 - The OMD's Department of Dental Surgeons shall be made up of all dental surgeons complying with the conditions defined in the previous Article, and shall be closed at the end of the CTP.

3 - During the period of continuous training and until they obtain their dentist degrees, the dental surgeons registered in the OMD's Department of Dental Surgeons shall have all the rights and duties defined in Decree no. 180-A/92 dated 4 June 1992 and in the agreement memorandum dated 9 February 1994.

4 - Regardless of that established in Article 51 of these statutes, the Department of Dental Surgeons shall appoint, until its demise, a representative for the OMD's professional conduct committee.

Article 104

Committee for Curricula Assessment

A committee for curricula assessment is hereby created within the OMD, the objective of which shall be to follow up and supervise the dental surgeons¿ incorporation into the OMD, and which shall be closed at the end of this process.

Article 105

Competence of the Committee for Curricula Assessment

It is within the competence of the committee for curricula assessment to:

a) assess the curricula of dental surgeons applying for the degree of dental practitioner and consequent registration in the OMD;

b) accredit the corresponding number of hours to the degrees of the dental surgeons applying for the degree of dental practitioner and consequent registration in the OMD;

c) decide on the applications handed in by dental surgeons within the following 60 days.

Article 106

Constitution of the Committee for Curricula Assessment

The committee for curricula assessment shall be made up of:

a) a personality of acknowledged reputation, appointed by the Ministers for Education and for Health;

b) the president of the OMD;

c) the president of the Brazilian Federal Dentistry Council;

d) two university representatives, one from Portugal and one from Brazil;

e) two OMD representatives;

f) two representatives of the Brazilian Dentist's Association (Associação Brasileira de Odontologistas - ABOP).

Article 107

Conditions for Application

1 - The dental surgeons referred to in Article 100 of these statutes, shall submit their application to the dentistry degree within 60 days following the enforcement of the above-mentioned decree.

2 - The applications mentioned in the previous paragraph shall be submitted to the committee for curricula assessment and are to contain the following documents:

a) personal and professional identification;

b) copy of the dental diploma witnessed by a notary public;

c) résumé and application form correctly filled in;

d) document proving the entry into Portuguese territory before 1 January 1994;

e) other supporting data, relevant to obtain the dentist degree and consequent registration in the OMD.

Article 108

Deontology and Disciplinary Jurisdiction

1 - The professionals mentioned in this chapter shall comply, provided the necessary adjustments, with the rules of professional conduct regulating the practice of dentistry, as defined in these statutes, the internal regulations, the OMD's code of ethics and other applicable norms.

2 - Therefore, the professionals referred to in the previous paragraph shall be under the exclusive disciplinary jurisdiction of the OMD¿s ethics and professional conduct committee, in accordance with these statutes and with full enforcement of the rules concerning disciplinary action, as defined in chapter IV, with the exception specified in the next paragraph. .

3 - Disciplinary sanctions shall be as follows:

a) warning;

b) reprimand;

c) suspension from practice for a maximum of five years;

d) interdiction from professional practice.

Article 109

Fees and Other Regulation Expenses

Professionals mentioned in Article 102 are bound to the payment of the OMD's annual fees and of any other regulation expenses to be defined by the board of directors.
