 13. Chapter IV - Section IV - Trial
 

Article 88

Sentence

1 - Should all the members of the ethics and professional conduct committee be entitled to vote, they shall cast their vote and the respective sentence shall be pronounced and signed.

2 - Should any of the members be unable to vote, the process shall be open to public consultation for a period of five days.

3 - At the end of this five-day period, a new trial session shall be held.

4 - The arbitrator shall not be entitled to vote except in the event of a tie, in which case he or she shall cast the decisive vote.

Article 89

Notification

1 - The final judgement shall be communicated to the plaintiff, the defendant, the president of the OMD and the board of directors.

2 - This notification shall comply with the terms and time limit defined in Article 72.

3 - This deadline shall be counted from the date of the above-mentioned judgement.

Article 90

Dealine for Trial

Disciplinary actions shall be tried within one year following the end of the preliminary proceedings.

Article 91

Appeals

The decisions of the ethics and professional conduct committee may be appealed to a court of law, in accordance with Article 6, no. 3.
