Article 51
Constitution and Election
1 - The ethics and professional conduct committee shall be made up of the president and four other members.
2 - All the members of the ethics and professional conduct committee shall be elected by the general assembly, on a separate list.
Article 52
Operation
1 - The meetings of the ethics and professional conduct committee shall be held when convened by the president or simultaneously by two members, in the location indicated in the call.
2 - The decisions of the ethics and professional conduct committee shall only be valid when at least three of its members are present.
3 - All decisions shall be on the basis of simple majority; in the case of a tie, the president, or, in the latter¿s absence, the most senior member of the OMD, shall cast the decisive vote.
Article 53
Competence
1 - It is within the competence of the ethics and professional conduct committee to:
a) pronounce in due time on any appeals concerning the decisions of the ruling bodies or their members;
b) deliberate disciplinary processes;
c) decide on the resignation, as well as the request for any temporary suspension from office, presented by its members;
d) deliberate the removal from office of any member holding a position in the ruling bodies;
e) decide on the substitution of its members;
f) notify those dentists whose registration fees are one year in arrears, in order that they should pay their debt within 30 days, lest a process of execution should be brought against them;
g) decide on the validity of the reasons presented by the regional representatives, as referred to in Article 46, no. 2, paragraph c);
h) give their view on any issues, as requested by the secretary-general;
i) elaborate the code of ethics and put it forward to the general assembly for its approval.
2 - In the process of execution mentioned in paragraph f) of the previous number, the unpaid receipts shall be used as evidence.
3 - The ethics and professional conduct committee shall be assisted by a legal assessor appointed by the president of the OMD.
Article 54
Members of the Ethics and Professional Conduct Committee
1 - The members of the ethics and professional conduct committee are entitled to vote and shall be in charge of raising the necessary disciplinary actions in compliance with these statutes, as well as of giving their view on those issues requested by the secretary-general.
2 - Any member¿s resignation, as well as his or her request for temporary suspension from office, must be presented to the ethics and professional conduct committee.
3 - The president has the decisive vote in the case of a tie, and must call and preside over the meetings as well as bring the necessary disciplinary actions.
