Article 38
Election
The president of the OMD shall be elected by the general assembly, made up of all dentists currently registered, in compliance with these statutes.
Article 39
Competence
1- It is within the competence of the President of the OMD to:
a) represent the OMD in courts of law and in all other instances, namely before the official authorities;
b) define, in harmony with the secretary-general, the position of the OMD before the official authorities and the Administration in that which concerns the OMD¿s competence and goals;
c) express, in collaboration with the secretary-general, the OMD's position regarding bills which concern the practice of dentistry, and put forward the amendments considered relevant;
d) supervise the enforcement of the legislation concerning the OMD and the fulfilment of its goals;
e) put forward the date for the election of the various bodies to the chairman of the general assembly;
f) convene general meetings, in compliance with these statutes;
g) manage the diverse national services of the OMD;
h) attend, if willing to do so, the meetings of the board of directors;
i) send back to the board of directors all those resolutions which he or she may oppose, justifying this disagreement and putting forward one or more alternative solutions;
j) implement, together with the secretary-general, the resolutions of the general assembly and of the board of directors;
l) elaborate, in combination with the secretary-general, the proposed budget for the following calendar year and put it forward to the board of directors;
m) elaborate, in combination with the secretary-general, the proposed plan of activities for the following year and put it forward to the board of directors;
n) carry out those budgetary expenditures within his or her competence;
o) promote the collection of the OMD's revenue;
p) promote, by his or her own initiative or upon request of the board or directors or of the dentist concerned, the necessary actions to provide the OMD¿s endorsement or legal assistance to dentists;
q) appeal to the ethics and professional conduct committee regarding any resolution of the OMD's ruling bodies, which may be in breach of these statutes, the legislation in force or the interests of the OMD and its members;
r) write those reports that may be requested about the issues within the sphere of his or her competence;
s) ask the secretary-general to request from the OMD¿s ruling bodies or its members the elaboration of reports about any issues that may concern the OMD;
t) choose the legal assessor of the ethics and professional conduct committee;
u) accept donations or legacies in favour of the OMD;
v) request the collaboration of the secretary-general for the discharge of his or her duties;
x) carry out all the duties in compliance with the laws and regulations in force, and demand the resignation or temporary suspension of the board of directors.
2 - The president of the OMD may delegate one or more responsibilities to the secretary-general.
3 - The president of the OMD, with the approval of the secretary-general, may also delegate one or more responsibilities to any member of the board of directors.
